What is mediation?
Mediation is a meeting of parties to decide what is best for each individual with the help of a mediator (comparative to a referee). Mediation is used in helping individuals and businesses solve problems in areas such as divorce, prenuptial arrangements, dissolution of non-marital relationships, child custody, business partnership dissolutions, and disputes with-in public and private organizations. In mediation, you create your own agreement and meet to work out major decisions. When there is a resolution, the mediator will draft a memorandum of the agreement reached and will give this to your attorney for legal implementation. Mediation focuses on present and future, rather than past. In mediation you are under no obligation to agree to anything since the involved parties control the outcome, unlike arbitration where the arbitrator makes the decisions in the case. Mediation is a amicable way of settling divorce where there are children and property involved. It deals with parenting arrangements, child support, division of property and spousal maintenance. Everyone can benefit from this and it can help both parties rather than engaging in an expensive and stressful legal contest.
