DRIVING UNDER THE INFLUENCE (DUI) CUASING INJURY

            Driving under the influence (DUI) causing injury is driving a vehicle when a person is under the influence (drunk, intoxicated, tipsy) of an alcoholic beverage or a drug or both and while driving under the influence, the person also committed an illegal act or neglected to perform a legal duty and the person’s illegal act or failure to perform a legal duty caused bodily injury to another person.
            It is also illegal to drive a vehicle when a person’s blood alcohol level was .08% or more by weight at the time of driving and he or she also committed an illegal act or neglected to perform a legal duty and the person’s illegal act or failure to perform a legal duty caused bodily injury to another person.
            An illegal act or failure to perform a legal duty can almost be anything involving negligence such as speeding or failing to stop at a stop sign or even failing to have a passenger wear his or her seat belt.
            Driving under the influence (DUI) causing injury can be a misdemeanor or a felony.
